Terms and conditions

Who these terms are for

These terms govern the contract between ALBR LLC and you as a private customer using Fotoheic.

They are written to be understood on the first read. If any part is not clear, email fotoheic@gmail.com and we will explain it.

What the service does

Fotoheic converts image files in HEIC and HEIF format into JPG. The conversion runs in your browser, on your own device.

What we owe you is a working tool, not a guaranteed result for every single file: a damaged or incomplete file cannot be converted, and in that case the program tells you which one it was.

You need a current browser. We test with the current versions of Chrome, Edge, Firefox and Safari.

Prices and how the contract is formed

Prices are shown in US dollars and do not include sales tax or VAT. Where tax applies where you live, it is added at the payment step and shown before you pay.

The paid contract is formed when you press the button showing the amount of $1.00.

Directly above that button you see it again: $1.00 today, a 7-day trial, then $9.99 a month or $49.99 a year, and a note that the subscription continues until you cancel.

After you sign up we email you a confirmation with all of it, so you have a copy you keep.

Trial and billing

The trial lasts 7 days from sign-up. The paid subscription starts the day after it ends, unless you have cancelled by then.

We email you the exact date and the exact amount of the first charge immediately after sign-up. Both are also visible in your account at any time.

The $1.00 you pay today is a one-off set-up fee and is not credited against the subscription.

After that, the plan you picked is billed in advance: $9.99 monthly or $49.99 yearly.

Who charges you and who invoices you

Payment is handled by Lemon Squeezy, Inc. as seller of record (Merchant of Record). That name appears on your invoice and card statement.

You get an invoice by email after every charge. On your statement the entry carries wording that mentions Fotoheic, so you can place it without having to ask us.

Length and cancelling

The subscription runs indefinitely and renews for the period you chose until you cancel.

You can cancel at any time using the “Cancel subscription” button in your account. It takes two steps. No call, no email, no reason required.

Cancelling takes effect at the end of the period you have already paid for. Until then you can keep using Fotoheic. You get a confirmation email with the date straight away.

Cancel during the trial and nothing is charged.

Changes to prices and to these terms

We may change prices and these terms for the future. We email you about any change at least six weeks before it takes effect.

If you do not want the change, cancel before it takes effect and the contract ends on that same date, at no cost to you. We say so in the notice itself.

The price of a period you have already paid for never changes afterwards.

How you may use it

Only use Fotoheic with files you have the rights to.

Do not share your sign-in details. The subscription is for the private use of one household.

Automated bulk use that degrades the service is not allowed.

Liability

We are liable without limit for damage caused intentionally or by gross negligence, and for death or personal injury caused by our negligence.

For ordinary negligence we are liable only for breaching an obligation that is essential to the contract, and then only for the loss that was foreseeable and typical of a contract like this one.

Nothing here excludes or limits any liability that the law does not allow us to exclude, and nothing here reduces the statutory rights you have as a consumer where you live.

A separate note, not a liability point: the conversion creates new JPG files and does not touch your originals. Keep the originals anyway until you have checked the results.

Governing law

If you live in the European Union, the European Economic Area or the United Kingdom, the mandatory consumer protection rules of the country where you live apply to you and these terms take nothing away from them. You can bring a claim in the courts where you live, and we can only bring one there.

Otherwise this contract is governed by the law of the State of Wyoming, United States.
